What Are the Grounds for Divorce in New York?

New York is a “mixed state” in that it allows couples to file for both no-fault and fault-based divorces. Since 2010, couples may file for a no-fault separation if they declare that their relationship has broken down irretrievably for a period of at least six months, or if they have lived separate and apart for at least one year. In other cases, a filing spouse may cite the alleged wrongdoing or “fault” of the other spouse in order to gain leverage in achieving a favorable settlement.

A fault-based divorce can be obtained for any of the following reasons:

• Abandonment for a period of one year or more
• Imprisonment of one spouse for more than three years
• Adultery

In addition to citing a reason for divorce, divorcing spouses must meet the state’s residency requirements, which are usually met if one or both spouses have lived in New York for at least one year prior to filing for divorce.
